Biden Commutes Sentences of 2,500 Nonviolent Drug Offenders in Final Days

In a historic use of presidential clemency, President Joe Biden announced Friday the commutation of nearly 2,500 sentences for individuals convicted of nonviolent drug offenses. The move underscores his administration’s commitment to addressing sentencing disparities and systemic inequities in the U.S. criminal justice system.

“Today’s clemency action provides relief for individuals who received lengthy sentences based on discredited distinctions between crack and powder cocaine, as well as outdated sentencing enhancements for drug crimes,” Biden said in a statement. “This action is an important step toward righting historic wrongs and providing deserving individuals the opportunity to return to their families and communities.”

A Record-Setting Legacy in Clemency

Friday’s announcement cements Biden’s position as the president who has granted the most individual pardons and commutations in U.S. history. Advocates for criminal justice reform applauded the decision.

Shaneva D. McReynolds, president of Families Against Mandatory Minimums (FAMM), praised Biden’s actions. “With today’s announcement, he has set a standard for presidential clemency and addressed decades-long injustices in our criminal justice system,” she said.

Sarah Gersten, executive director of the Last Prisoner Project, emphasized the broader implications of the decision. “This provides hope — not just for those freed today, but for all individuals still incarcerated for cannabis and their families who have been impacted by the War on Drugs,” Gersten said.

The commutations follow a series of clemency actions by Biden in recent months, including pardoning 39 Americans convicted of nonviolent crimes and commuting the sentences of 1,500 individuals on home confinement during the pandemic.

Looming Questions About Preemptive Pardons

Biden’s final days in office are also marked by discussions about issuing preemptive pardons for officials and allies who may face investigations by the incoming Trump administration. While such moves are constitutional, they would represent a rare and controversial use of presidential powers.

Notably, Biden recently pardoned his son, Hunter Biden, for federal gun and tax violations and any potential offenses over an 11-year period. Critics argue the decision reflects Biden’s concerns over political retribution from Trump’s team.
